2nd Regional Seminar of the e-APP European project for an e-Apostille

On May 27, 2011 was Held in Prague the Second Regional Meeting Organized by The Hague Conference on Private International Law on e-Apostille.

The meeting was organized by the Ministry of Justice of the Czech Republic, the Permanent Bureau of The Hague Conference on Private International Law (HccH) and the Ministry of Justice of Spain. The project is funded by the European Commission.
 
The Apostille is a method that allows an authentic document issued in a state to be recognized and used in another state, without any need for a complicated and expensive recognition procedure. The convention of 5 October 1961 abolishing the requirement of legalisation for foreign public documents, the "Apostille Convention", is the work of The Hague Conference on Private International Law. It is currently used by 101 states. Among the thirty-nine conventions of the Hague Conference, it is the most widely used worldwide. The Hague Conference initiated in 2006 a large movement to help the Apostille enter the digital age. The e-APP (for e-Apostille Pilot Program) Project is to coordinate the actions of states to develop and harmonize an electronic Apostille. It is planned for a period of eighteen months. Spain is a partner in the project. Finland, France and the Czech Republic are associate partners.
 
After Helsinki (Finland) in February 2011 (see our article on our site), it was the turn of the Czech Republic to host nearly fifty participants from twenty delegations from Europe but also South America and Asia. The UIHJ was represented by its First Secretary, Mathieu Chardon.
 
Zuzana Fišerová, director of the International Department of Civil Affairs (Czech Republic), welcomed the participants and wished them fruitful work. José de la Mata Amaya, Director General of the Modernization of the administration of justice of Spain, head of the e-APP for his country, thanked the participants. He announced that the e-Apostille is now operating in Spain.
 
Christophe Bernasconi, First Secretary of the Hague Conference, welcomed all participants. He thanked in particular Spain and José de la Mata Amaya for their work in the field of electronic Apostille, the representative of the European Commission for financial support to the project, and Lucia Prieto Rios, project manager hired by The Hague Conference and the Ministry of Justice of Spain. He reintroduced the e-APP, especially to the attention of new participating countries. He noted that this convention is the most used of the 39 conventions elaborated by The Hague Conference. Despite its almost fifty years of existence, the Apostille Convention of 5 October 1961 is more than healthy: most countries have adopted it over the last ten years to be now used in 101 countries. Mr Bernasconi stressed the value of the e-Apostille, as he had done at Helsinki, highlighting the latest advances.
 
Pavla Bellonova, Head of Private International Law Department of the Ministry of Justice of the Czech Republic, made a presentation of the basis for the possible implementation of the e-APP in her country. She said that this implementation is based on a service of documents by secured electronic means and preliminary work on the e-Register of Apostilles.
 
José de la Mata Amaya, Angelines Turon Turon and Javier Parra (Spain), informed the participants of the recent developments of e-APP in Spain. A ministerial order establishing the creation of the e-Register of Apostilles has recently been published, on 14 May 2011. A Royal Decree should follow to designate the competent authorities for the issuance of the e-Apostilles in Spain). Mr de la Mata Amaya showed a promotional film about the Spanish e-Apostille. A roundtable on the future of e-Apostille in Central and Eastern Europe was then held. This particular issue of the exportability of existing e-APP systems such as the Spanish model was discussed. Representatives of the Czech Republic, Spain, Hungary, Romania and Slovakia participated in this panel, chaired by Christophe Bernasconi.
 
Then Niovi Ringou, representing the European Commission, discussed with the First Secretary of the Hague Conference, under the chair of Mayela Celis (HccH), the issue of e-Apostille as a means to further facilitate the prompt and secure use of public documents within the European Union and abroad.
 
Finally, conclusions and recommendations of the meeting were proposed and adopted by the participants. Among these, it was noted that the Contracting States are encouraged to actively consider the implementation of the e-APP as an effective tool to further enhance the secure and effective operation of the Apostille convention. It was also mentioned that several States are considering the possibility of implementing the Spanish e-APP system.
 
The final e-APP regional meeting will be held in Paris (France) on 4 and 5 October 2011. This event will correspond exactly to the fiftieth anniversary of the Apostille Convention. This is obviously not a coincidence!
