The UIHJ Attended on 8 to 11 June 2011 the 2nd International Conference on Theoretical and Practical Effectiveness of Enforcement of Court Decisions, Organized by the Federal Service of Judicial Officers of the Russian Federation in Cooperation with the University of Kazan (Volga Region)

The conference came as a follow up of the conference that took place in July 2010 in St. Petersburg which saw the attendance of Bernard Menut, first vice president of the UIHJ. The UIHJ was represented by Jos Uitdehaag, 1st quaestor of the Committee of the UIHJ, Marc Schmitz, Quaestor of the Committee of the UIHJ, and Carlos Calvo, president of the Chamber of Judicial officers of Luxembourg.
Delegations from Eastern and Western Europe were present. Alongside representatives of both Russian professional and academic worlds, the conference was attended by representatives of Armenia, Azerbaijan, Belarus, Czech Republic, Georgia, Germany, Moldova, and Portugal.
The conference addressed "classics" themes such as the effectiveness of enforcement actions in various countries, conduct and ethics, protecting the rights of debtors in enforcement proceedings, search for information on heritage and access to databases. "Innovative" topics were also discussed such as internet auction and mediation. The rights of children were also significantly addressed. During an official ceremony, the best judicial officer as regards the respect of the rights of children was honored. The Russian authorities wanted to show how the rights of children now occupied a prominent place in enforcement in the Russian Federation.
For their part, academics called for a balance between, on one hand, effective enforcement measures and, on the other hand - and especially-a respect for the rights of the debtor. While the best decision in the world is worthless if it cannot be enforced effectively, it is also true that a blind enforcement, without regard for the rights of the debtor, is not favorable to the proper development of an effective judiciary in a constitutional state. There was also the issue of anti-constitutionality of certain enforcement measures such as, for example, to prohibit a debtor from leaving the country until his/her debts are settled. This is undoubtedly an effective enforcement measure, but highly questionable in terms of fundamental rights of a person.
After the work of the conference, participants were able to enjoy the legendary Russian hospitality while embarking on an unforgettable cruise on board of a ship on the Volga.
The success of the event is undoubtedly due to the excellence of its organization by the University of Kazan and the Federal Service of Judicial officers of the Russian Federation and its director, Artur Parfenchikov.
