A New Cycle of Evaluation

The semi-annual pleanary session of the European Commission for the Efficiency of Justice (CEPEJ), brings together the representatives of the 47 Member States of the Council of Europe as well as the permanent observer members such as the UIHJ and of the representatives of the European Union, the Hague Conference on Private International Law and of the Council of Europe. The UIHJ was represented by Leo Netten, 1st vice-president, and by Mathieu Chardon, 1st secretary.
The plenary session is the occasion to give a report of the whole of the work completed during the year and to envisage an agenda for the year to come.
The meeting was chaired by Fausto de Santis, president, assisted by Stéphane Leyenberger, secretary and Muriel Decot, co-secretary. The meeting was opened by Margaret Killerby, director of the legal cooperation of the Council of Europe, who insisted on the crucial role of the CEPEJ “in the implementation of the fundamental principles and the priority activities of the Council of Europe in the sphere of the Rule of law”.
On the agenda a report was made on the “European judicial systems - Edition 2008 (data 2006)”, which was made public on October 8th, 2008. Every two years, the CEPEJ indeed publishes such a report, which includes an aspect on enforcement of the legal decisions. In this report, which was commented by Jean-Paul Jean, president of the CEPEJ-GT-EVAL (working group of the CEPEJ on the evaluation of judicial systems), the CEPEJ concludes that “It is essential that the enforcement agents have a reliable and suitable training and an adequate qualification to allow the person concerned to efficiently and reasonably apply enforcement proceedings, while safeguarding the fundamental rights and individual freedoms”. A new cycle of evaluation was decided for 2009 on the database of the year 2008. It will be published in 2010. The CEPEJ-GT-EVAL was also invited to start a study relating to the organization of the courts and the legal chart, intended to be published in 2009 in the series “Studies of the CEPEJ”.

Creation of the CEPEJ-GT-EXE

Within the framework of the cooperation with the European Union (EU), the secretariat of the CEPEJ underlined the engagement of the CEPEJ in the Forum for justice of the EU, through the participation in the plenary sessions as well as within the working groups.
Leo Netten and Mathieu Chardon presented an assessment of the activities of the UIHJ for the second half-year 2008 and indicated that the next international congress would be held in Marseilles (France) from September 7th to 11th 2009.
The programme for the year 2009 was adopted. In particular, the CEPEJ-GT-EXE (working group of the CEPEJ on enforcement of legal decisions) must be formed to hold its first meeting on January 29th and 30th 2009. The UIHJ should take part in this work group as an observer member, after the approval of the bureau of the CEPEJ.
