The European Commission for the Efficiency of Justice (CEPEJ) has recently published a specific study on enforcement agents, prepared by the International Union of Judicial Officers (UIHJ), an observer at the CEPEJ. This study, based on data collected by the CEPEJ in 2022, enriches the latest Evaluation Report on European Judicial Systems, which was published in October 2024. It is available on the CEPEJ website and its dedicated database, CEPEJ-STAT.
Organization of the Enforcement Agent Profession
The study highlights the diversity of enforcement agents’ statuses across Europe. Some countries favor a private status, granting agents independence in carrying out their duties, while others opt for a public status, integrating them directly into the judicial administration. This diversity reflects the legal and administrative traditions specific to each member state.
Implementation of Civil and Criminal Enforcement Procedures
The effectiveness of enforcement procedures is essential to ensuring compliance with court decisions. The study emphasizes the importance of continuous training for enforcement agents, allowing them to adapt to legislative and technological developments. Additionally, access to relevant debtor information, such as land registries or bank accounts, is crucial for efficient and fair enforcement.
Supervision of Enforcement Activities
The supervision of enforcement agents varies from country to country. Some have independent oversight bodies, while others entrust this responsibility to judicial or administrative authorities. The common objective is to ensure transparency, efficiency, and respect for fundamental rights in the enforcement process.
This study is a valuable resource for policymakers, legal professionals, and researchers, providing a detailed analysis of the enforcement agent profession in Europe. It highlights best practices and offers recommendations to improve the efficiency and quality of enforcement procedures, thereby strengthening public confidence in the judicial system.
