Comme vous pourrez le constater en parcourant la présente Newsletter, depuis notre dernière Newsletter d’avril 2022, l’UIHJ a participé à de nombreux événements qui témoignent une fois encore de notre implication totale pour défendre les intérêts de la profession d’huissier de justice et assurer sa promotion sur le plan mondial.

Les deux prochains mois d’été vont vous permettre, je l’espère, de prendre quelques vacances bien méritées, de vous ressourcer en famille et entre amis, et d’oublier temporairement les tracas quotidiens.

Entrée en application le 1er juillet 2022 du règlement (UE) n° 2020/1784 sur la signification |
| |
Le règlement (UE) n° 2020/1784 du Parlement européen et du Conseil du 25 novembre 2020 relatif à la signification et à la notification dans les États membres des actes judiciaires et extrajudiciaires en matière civile ou commerciale a été publié au Journal officiel de l’Union européenne le 2 décembre 2020 (L 405). Il est entré en vigueur vingt jours ouvrables après cette date et est applicable à compter du 1er juillet 2022. En vue de sa bonne application, vous trouverez ci-après quelques précisions et conseils.

Près de 200 représentants de 20 pays ont assisté aux 6es Rencontres Afrique-Europe des huissiers de justice à Cotonou (Bénin) du 23 au 25 juin 2022 |

L’UIHJ a organisé avec la Chambre nationale des huissiers de justice du Bénin, sous l’égide du ministère de la justice du Bénin, les 6es Rencontres Afrique Europe des huissiers de justice sur le thème de « L’huissier de justice à l’ère de la digitalisation », au Palais des congrès de Cotonou. Ces rencontres ont été dédiées à la mémoire de feu Marcellin Comlan Zossoungbo, ancien président de la Chambre nationale des huissiers de justice du Bénin.
Ces rencontres dont il convient de saluer la parfaite organisation grâce à l’implication et au travail de Charles Coovi, président de la Chambre nationale des huissiers de justice du Bénin, et des membres de son bureau, ont rencontré un succès total auprès de l’ensemble des participants.

2ème édition dans la série de webinaires pratiques sur l’exécution dans les pays étrangers : « Comment exécuter en…?» |

Le deuxième webinaire de l’UIHJ sur l’exécution a été organisé en ligne le mardi 14 juin 2022. Il concernait l’exécution des décisions de justice en Finlande, en Suède et au Danemark.
Les intervenants étaient :

Finlande : Mari Vihriälä, directrice du service clients du bureau national des exécutions et Annika Björkqvist, huissier de justice, officier de liaison international de l’association finlandaise des huissiers de justice

L'exécution transfrontalière des jugements - l'Europe du Sud-Est |

Une publication a été réalisée dans le cadre du projet « L’exécution transfrontalière des jugements » financé par le ministère fédéral allemand du Développement économique et de la Coopération (BMZ) et mis en œuvre par GIZ en étroite collaboration avec l’UIHJ.

La Géorgie aide l'Ukraine |
| |
Des employés du Bureau national de l'exécution et des cadres privés se sont réunis pour aider leurs collègues ukrainiens. Plusieurs centaines d'employés et de cadres privés du Bureau national géorgien de l'exécution ont collecté 7 000 dollars sur leurs salaires pour le peuple ukrainien. L'argent collecté a déjà été transféré à un fonds caritatif spécialement créé par les huissiers de justice ukrainiens.

2e Atelier international sur l’exécution des décisions de justice à La Havane (Cuba) |

Une délégation de l’UIHJ, composée de Marc Schmitz, président, et de Luis Ortega Alcubierre et Jean-Didier Bidié, vice-présidents, s’est rendue à La Havane (Cuba) du 8 au 10 juin 2022 pour participer au 2e Atelier international sur l’exécution des décisions de justice.
Cet atelier, tenu le 9 juin à l’hôtel SO/ Paséo del Prado, a été présidé par Ruben Remigio Ferro, président du Tribunal Supremo Popular de Cuba, et par Marc Schmitz, sous la modération de Farah M. Saucedo Perez, vice-présidente de cette haute juridiction.

Projet de renforcement de l’exécution dans les Balkans (BESP) : aperçu des activités récentes et futures |

L’UIHJ est impliquée dans de nombreux projets internationaux visant à renforcer l’Etat de droit, notamment en ce qui concerne l’exécution et la profession d’huissier de justice et d’agent d’exécution. Cet article est destiné à donner un aperçu de nos activités récentes dans le cadre d’un de ces projets où l’UIHJ est représentée par son premier vice-président, Jos Uitdehaag.

Forum régional « Convention HCCH 2019 sur les jugements : perspectives pour les Balkans occidentaux » |
| |
Le Forum régional « Convention HCCH 2019 sur les jugements : perspectives pour les Balkans occidentaux » aura lieu les 30 juin et 1er juillet à Skopje, en Macédoine du Nord. Cet événement est co-organisé par le « Balkans Enforcement Strengthening Project (BESP) » financé par le ministère néerlandais des Affaires étrangères et mis en œuvre par le Centre de coopération juridique internationale (CILC) et le projet « Réforme juridique pour le développement économique dans les Balkans occidentaux » financé par le ministère fédéral allemand du Développement économique et de la Coopération (BMZ) et mis en œuvre par la Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ). L’événement est organisé en coopération avec la Conférence de La Haye de droit international privé (HCCH) et l’Union internationale des huissiers de justice (UIHJ).

Arménie : Organisation d’un débat thématique à l’occasion de la 15e Journée mondiale de l’huissier de justice |

Le 9 juin, le chef de l’exécution forcée de la République d’Arménie, Sergey Meghryan a tenu un débat thématique à l’occasion de la 15e Journée mondiale de l’huissier de justice avec la participation de l’équipe dirigeante et des agents d’exécution. Chaque année, lors de cette journée, les Etats-membres de l’UIHJ participent à cet événement sous différentes formes. Le thème des débats de cette année était : « L’huissier de justice, élément de stabilité dans un monde qui change ».

Réseau judiciaire européen en matière civile et commerciale - 86e réunion des points de contacts (Bruxelles, 23-24 juin) |

Au cours de la 86e réunion des points de contact du Réseau judiciaire européen, un certain nombre de questions cruciales ont été discutées en ce qui concerne le présent et l’avenir des preuves transfrontalières et de la signification des actes de procédure au sein de l’UE, à savoir le règlement UE 1206/2001 , 1393/2007, 2020/1783 et 2020/1784.

La Commission européenne pour l’efficacité de la justice du Conseil de l’Europe (CEPEJ), créée le 18 septembre 2002 par la Résolution Res(2002)12 du Comité des Ministres du Conseil de l'Europe, a célébré son 20e anniversaire en amont de sa 38e réunion plénière à Malte et en ligne, les 27 et 28 juin 2022.

Le conseil permanent a été ouvert en présence de Ramin Garagurbanli, président de la Commission européenne pour l’efficacité de la Justice du Conseil de l’Europe, Erekle Ghvinianidze, vice-ministre de la justice de Géorgie, et de Leo Netten et Françoise Andrieux, présidents honoraires de l’UIHJ.

Cette année, l’UIHJ fête ses 70 ans et la CEPEJ ses 20 ans.
Créée le 18 septembre 2002 par la Résolution Res(2002)12 du Comité des Ministres du Conseil de l’Europe, la Commission européenne pour l’efficacité de la justice vise à promouvoir l’Etat de droit et les droits fondamentaux en Europe, sur la base de la Convention des droits de l’homme.
La CEPEJ s’est rapidement imposée comme une institution incontournable, s’appliquant à elle-même l’efficacité qu’elle promeut pour la justice.
L’UIHJ tient à remercier son président, Ramin Garagurbanli, pour tout ce qu’il a fait pour contribuer au domaine de l’exécution, à son organisation et à l’innovation en cette matière.

As you will be able to see by browsing through this Newsletter, since our last Newsletter of April 2022, the UIHJ has participated in many events which once again testify to our total involvement in defending the interests of the profession of judicial officer and promote it at global level.

The next two months of summer will allow you, I hope, to enjoy some well-deserved vacations, to focus on family and friends, and to temporarily forget the daily issues.

Regulation (EU) 2020/1784 of the European Parliament and of the Council of 25 November 2020 on the service in the Member States of judicial and extrajudicial documents in civil or commercial matters (service of documents) has been published in the Official Journal of the European Union on 2 December 2020 (L 405). It entered into force twenty working days after this date and is applicable from 1st July 2022. With a view to its proper application, you will find some clarifications and advice below.

Nearly 200 representatives from 20 countries attended the 6th Africa-Europe Meetings of Judicial Officers in Cotonou (Benin) from 23 to 25 June 2022 |

The UIHJ organised with the National Chamber of Judicial Officers of Benin, under the aegis of the Ministry of Justice of Benin, the 6th Africa Europe Meetings of Judicial Officers on the theme of “The Judicial Officer in the era of digitalisation”, at the Congress Palace in Cotonou. These meetings were dedicated to the memory of the late Marcellin Comlan Zossoungbo, past President of the National Chamber of Judicial Officers of Benin.
The meetings, perfectly organised thanks to the involvement and work of Charles Coovi, President of the National Chamber of Judicial Officers of Benin, and the members of his board, proved to be a total success.

The 2nd practical webinar of the UIHJ on enforcement in foreign countries: “How to enforce in …” dealt with Finland Sweden and Denmark, and has been held on Tuesday 14th June 2022.
The speakers were:

Georgia helps Ukraine |
| |
Employees of the National Bureau of Enforcement and private executives came together to help their Ukrainian colleagues. Several hundred employees and private executives of the Georgian National Bureau of Enforcement have collected $ 7 000 from their salaries for the Ukrainian people. The collected money has already been transferred to a charity fund specially created by the Ukrainian enforcement officers.

2nd legal international workshop on the enforcement of court decisions in Havana (Cuba) |

The Regional Forum “HCCH 2019 Judgments Convention: Prospects for the Western Balkans” will take place on 30th of June and 1st of July in Skopje, North Macedonia. This event is co-organized by the “Balkans Enforcement Strengthening Project (BESP)” funded by the Dutch Ministry of Foreign Affairs and implemented by the Center for International Legal Cooperation (CILC) and the project “Legal Reform for Economic Development in the Western Balkans” financed by the German Federal Ministry for Economic Development and Cooperation (BMZ) and implemented by Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ). Armenia : Organization of a thematic-discussion devoted to the 15th World Day of the Judicial Officer |

On 9th of June, the Chief Compulsory Enforcement Officer of the Republic of Armenia, Sergey Meghryan held a thematic-discussion on the occasion of the 15th World Day of the judicial officer with the participation of the management team and enforcement officers. Each year, on this day, member-states of the UIHJ participate in this event in various formats. The theme of this year’s discussion was: “Judicial Officer, element of stability in a changing world.”

European judicial network in civil and commercial matters - 86th meeting of the contact points (Brussels, 23-24 june) |

In the course of the 86th Meeting of the Contact Points of the European Judicial Network, a number of crucial issues were discussed with respect to the present and the future of cross border evidence and service of process within the EU, namely EU Regulations 1206/2001, 1393/2007, 2020/1783 and 2020/1784.

This year, the UIHJ celebrates its 70th anniversary and the CEPEJ its 20th anniversary.
Established on 18 September 2002 with Resolution Res(2002)12 of the Committee of Ministers of the Council of Europe, the European Commission for the Efficiency of Justice aims to promote the Rule of Law and Fundamental Rights in Europe, on the basis of the European Convention on Human Rights.
The CEPEJ quickly established itself as an essential institution, applying to itself the efficiency it promotes for justice.
UIHJ would like to thank Ramin Garagurbanli for everything he has done to contribute to the field of enforcement, its organization and enforcement innovation.
