A well covered conference from the media and the authorities
For a first attempt, the young National chamber of the judicial officers of Chad and its president, Elysé Eldjimbaye (the liberal profession was created in 2001) carried out a master plan with the organization of the international conference which was held February the 23, and 24 2006 in Ndjamena on the topic of the “recovery of the debts of the procedure of injunction to pay and of the role of the judicial officer”.
Widely diffused in the press, this conference received the support of the media and was very noticed by the authorities.
Thus the delegation of the UIHJ accompanied by president El Djimbaye and the vice secretary, Foamed Youssouf, was to be received in the temporary absence of the Minister of Justice, Keeper of the Seals, by the General Bichara Issa Djdallah, minister delegated to the Presidency of the Republic, Minister for the Defense, who greeted warmly the delegation.
The closing session was chaired by Edouard Ngarta Mbaiouroum, Minister of Justice, who had come back from a voyage and who made a point of greeting the Chadian participants and those coming from the close countries as well as the delegation of the UIHJ.
In his word of conclusion, president Eldjimbaye stressed out a certain number of requests coming from the judicial officers, in particular as regards tariffs, of payment by the State of the penal matter exploits and the conditions of attribution of the assistance of the police force.
In his final intervention the Minister of Justice did reassure our colleagues on at least one point: that of the revision of the tariffs texts.
The independence of the judicial officers
Jacques Isnard, president of the UIHJ, was to finally reaffirm the essential character for any State of law to have a body of liberal judicial officers, independent, responsible and fully trained.
He was to show how much the concepts of the State of law and the independence of the judicial officer were closely bound, in particular in the fight against corruption for which it was important, for the authorities, to support without reserve the action of the judicial officers.
In its ultimate matter, Mr Isnard cordially congratulated Me Eldjimbaye and the Chamber of judicial officers of Chad for the quality of the organization and the welcome reserved to the participants.
More than 100 participants
The conference took place et the Kempinski hotel - newly inaugurated - in front of more than 100 participants gathering, in addition to the 15 bailiffs of the country, magistrates, representatives of the police force and constables, as well as the largest banks in place.
The selected topic was declined around five workshops each one aiming at an aspect of the texts of the OHADA with first of all a general presentation of the OHADA and uniform acts including their incidences with regard to the judicial officers (Claudine Mougni and Rose-Marie Bruno). Then - in a 2nd workshop Alphonse Kibakala, president of the national chamber of the judicial officers of Congo, combined with Mrs Bruno, developed the topic of the recovery of the debts by treating aspects, techniques and psychology of debt collecting. This workshop obtained a great success, in particular with the explanations of Mrs Bruno over the techniques of communication.
A stream of questions until the closing of the conference room!
More technical was the 3rd workshop with the study of “obtaining the enforcement title and the injunction to pay” presented by a college of specialists including, in addition to the untiring Mrs Bruno (expert from the French National school of procedure), Claudine Mougni (from Benin, secretary of the UFHOJA), and Mr. Ngueneloum Terkam, magistrate, president of the commercial court of N'Djamena. Here is a subject which never leaves the audience indifferent and which caused in the circumstance, a stream of questions, some of which that could not be answered, due to a durable prolongation of the debates up to a late hour: the closing of the conference room!
The 5th workshop, chaired by Honoré Aggrey (Ivory Coast), permanent secretary of the UIHJ for central and Western Africa, by Jacques Isnard, president of the UIHJ, and Ramadane Souleymane, vice president of the National Chamber of judicial officers of Chad, was to collect its usual comments with, as a central point, the constant difficulties encountered by the Chadian colleagues as regards granting the assistance of the police force and also, acting to denounce the intrusion of the judicial power (magistrates - public authorities), in the assistance itself of the police force.
Respect of the principle of the three pillars
It is certain that the State of law, of which many pride on, will only be able to really open out when each one will be confined in the functions which the Constitution and the law allot to him. For that, it will be necessary that all the interested parties decide to respect the principle of the three pillars on which the base of any democracy rests and which traces the limits of the separation of powers.
The last workshop, relating to the study, always very awaited, of ethics, was very well lead by Mr Aggrey, Mr Kibakala and Mrs Mougni.
Unfortunately the debates could not go to their terms because of the program and the schedule of the closing ceremony.
The abundant distribution of the booklets published by the UFOHJA and the comments which were carried on until late afternoon ended this extremely rich conference, in all points, and which will remain engraved in the memories of our Chadian colleagues.

During the conference of N'Djamena, and as it came to an end, Rose Marie Bruno, expert from the French national school of Procedure (ENP) and speaker, particularly noticed and appreciated, had the pain to learn the death of her father.
The National chamber of Chad and its president, Mr Eldjimbaye, are due to express their greatest recognition for the contribution of Mrs Bruno to the conference and for the dignity and the courage which she expressed before her return in France.
The National chamber of the judicial officers of Chad would like to express to Mrs Bruno its deepest sympathy and present its sincere condolences to her.
The UIHJ joins the emotion of the National chamber of Chad and shares the pain of Mrs Rose-Marie Bruno and her sister, Cinzia Bruno, our two colleagues associated within the same office in Arles (France).
