Twinning agreement between the UIHJ and the University of Mendoza

At the occasion of a colloquium organised by the University of Mendoza (Argentina), the UIHJ and this university signed on 2 October 2012 the first twinning agreement between our organization and a university

On 1st and 2nd October 2012, under the impulse of Professor Aida Kemelmajer Carlucci, a member of the Scientific Council of the UIHJ and the Dean of the University Emilio Vazquez Viera, a colloquium on the theme of  "The execution of judicial decisions. Solutions in comparative law. Proposals to reform the local legislation" was held at the University of Mendoza. The delegation from the UIHJ consisted in Leo Netten, president, Luis Ortega Alcubierre, Vice-Secretary of the board, and Françoise Andrieux, Secretary General.
Four large round tables were set up to develop the themes.  At the first roundtable entitled "Enforcement of judgments in Europe," the president of the UIHJ presented the guidelines of the CEPEJ and more precisely the status of the enforcement agent as drawn in this document. Françoise Andrieux explained the status of the French judicial officer and Luis Ortega, the system of enforcement in Spain. The round table ended with several exchanges initiated by an audience made curious by the presentations.
"The execution of judicial decisions in the Republic of Chile", the theme of the second round table was entrusted to professors Raul Tavolari (National University of Chile) and José Pedro Silva (Catholic University of Chile). Both members of the reform commission they developed the outline of the reform of the Code of Civil Procedure in Chile.
The third round table "Problems of executions in Argentina" anticipated the need for a judicial reform in Argentina. Alejandro Boulin (University of Mendoza) explained the current system in force in the Code of Civil Procedure both at national level and in the province of Mendoza.
Ines Rauek, professor at the University of Mendoza treated the topic of conflicts resulting from the enforcement of court decisions. Then, finally Alejandro Perez Hualde, representing the Ministry of Justice focused on the enforcement of judgments against the State.

Finally, Professors Aida Kemelmajer de Carlucci and Oscar Vazquez presented the long-awaited proposal to reform the Code of Civil Procedure of Mendoza which great innovation is to propose as main actor the enforcement officer and to define his powers.
They recalled that in Argentina, enforcement is carried out by several actors (some attach goods, some serve documents, others proceed with the sale of attached goods...). Their reform proposal is based on the concentration of the execution in the hands of a single enforcement officer.
The UIHJ is of course very attentive to the reform in the province of Mendoza hoping it will be the start of a national reform.
At the end of these rich exchanges was signed the cooperation agreement between the UIHJ and the University of Mendoza, which provides improved training services related to their collaboration in scientific research.
There is a commitment to develop courses, seminars, and training to achieve this cooperation, which we hope will form the new enforcement agents of the province of Mendoza.
