Two UIHJ Experts Take Part in a CARDS Program in Skopje

On February 21 and 22 2007, Two UIHJ Experts Intervened at The Request Of The Council Of Europe In Skopje (Fyrom) Within The Framework Of A Regional CARDS Program Financed By The European Community.

Promotion In The Balkans Of An Effective Legal System
The aim in view by the European Union, in close cooperation with the Council of Europe, is to promote in the Balkans a safe and effective legal system legal. The enforcement of court decision is from this point of view one of the key elements of the effectiveness of a legal system.
The presence of the two UIHJ experts (Bernard Menut, secretary, and Jos Uitdehaag, 1st Quaestor of the Committee) were a pledge of professionalism and success of the event. The two experts endeavored to present on the one hand the recommendations of the Council of Europe as regards enforcement and on the other hand to define the profile of the European judicial officer.
The representatives of Albania, of Bosnia & Herzegovine, of Croatia, of the Former Yugoslavian Republic of Macedonia (FYROM), Serbia and Montenegro could exchange with the experts on the compared merits of the various statutes of enforcement agents. Indeed, only FYROM chose a system of independent enforcement agent. It appeared clearly that this country was a leader in the area as regards evolution of its system of enforcement. The other countries present different stages for the evolution of the statute of their enforcment agents.

To Improve the Training of the Enforcement Agents
The experts could note that certain countries had however the will to quickly advance in order to reach a real effectiveness of their system of enforcement of court decisions. It is the case with Albania which did an important work in this direction.
The topic of the training of enforcement agents, both former and on going, was also considered by the participating countries a key point, each one agreeing on the need to re-evaluate the level in its own country. At this occasion the experts could present solutions to improve the training of the professionals of enforcement.
The control mechanisms of the activity of the enforcement agents were presented by the experts making it possible to regain the confidence of the public with regard to the professionals. The ethics of the latter, and the definition of clear ethical rules, seems a need for the immediate future.
Work was completed with the development and the adoption of recommendations.
