Participation of the UIHJ in the 28th Plenary Meeting of the CEPEJ in Strasbourg on 6 and 7 December 2016

As a permanent observer member, the UIHJ participates in the semi-annual plenary meetings of the European Commission for the Efficiency of Justice of the Council of Europe (CEPEJ). The UIHJ was represented by Sue Collins (USA), Member of the Board, and Mathieu Chardon, Secretary General.

At the opening of the meeting, André Potocki, Judge at the European Court of Human Rights in respect of France, former Vice-President of the CEPEJ, praised the work of the CEPEJ, a "strong and productive institution". He recalled that the publication of the CEPEJ reports was an important closely monitored moment in the life of the member states of the Council of Europe. The creation of the CEPEJ-STAT database constitutes, according to him, a major step forward. André Potocki then referred to the very specific links between the European Court of Human Rights and the CEPEJ. He considered that the CEPEJ plays an essential role in the implementation of the principle of subsidiarity and is working to improve judicial systems. Thanks to the work of the CEPEJ, he considered that the principles protected by the European Convention on Human Rights were better implemented, which led to a reduction in the number of appeals to the European Court of Human Rights.

The agenda of the 28th Plenary Meeting was particularly full and the topics covered were numerous. Among these, a presentation of the 6th CEPEJ Report on Judicial Systems was made by Jean-Paul Jean, Chair of the CEPEJ Working Group on Evaluation (CEPEJ-GT-EVAL). The new report, largely dematerialised and hosted on the CEPEJ-STAT portal, truly represents a considerable step forward in the processing of data by the CEPEJ. A simplified report was also published in paper form. Mr Jean pointed out that the legal professions are not included in this simplified report. However, it was proposed that these professions, together with the CEPEJ-GT-EVAL, could analyse the existing data in order to prepare and present a report on the legal professions themselves. Mathieu Chardon congratulated the CEPEJ on the work accomplished. He indicated that the UIHJ was at the disposal of the CEPEJ for the preparation of this report with regard to the part concerning the profession of judicial officer.

Implementation of the 2016-2018 Evaluation Cycle was discussed, as was co-operation with the European Union in the framework of the "Justice Scoreboard", a cooperation which was deemed extremely fruitful. François Paychère, Chair of the CEPEJ Working Group on the Quality of Justice (CEPEJ-GT-QUAL) presented the work under way, which was adopted during the meeting:
- Indicators for measuring the quality of justice;
- Guidelines on how to drive changes towards Cyberjustice;
- Guide to good practice by some member states of the Council of Europe to improve the functioning of justice;
- Update of the Handbook on conducting satisfaction surveys for court users (CEPEJ (2010) 1).

Jacques Bühler, Chair of the Steering group of the Saturn Centre on Judicial Time Management, informed the members of the CEPEJ about current activities, in particular the draft "Implementation Guide: towards European timeframes for judicial processings". The various ongoing country cooperation programs (Albania, Azerbaijan, Croatia, Kosovo, Moldova), or to come (Jordan, Morocco, Palestine, Tunisia, Turkey) were also discussed during the meeting.

Vivien Whyte, newly elected President of the European Union of Rechtspfleger, presented the White Paper of the European Union of Rechtspfleger, a copy of which was handed over to the UIHJ.

Mathieu Chardon announced to the CEPEJ members the very recent creation of the European Union of Judicial Officers (UEHJ), comprising 25 countries, whose purpose is to represent the profession of judicial officer before the European institutions while remaining an entity internal to the UIHJ.

Statutory elections were held at the end of the meeting. The UIHJ congratulates the four candidates who are all re-elected at the board of the CEPEJ for the next two years: Georg Stawa (President), Ramin Gurbanov (Vice-President), Ivana Borzova (member) and Noel Rubothan (member).
