The Scientific Council : Professors Of University, High-Ranking Judges And Specialized Lawyers
The Institute of International Private Judicial Law and Enforcement Law is a branch of the UIHJ. It was created to support the legal research, the development of private international law, the vocational training, the study and the publication of works, legal and communication researches, and finally the creation of a “world library”.
The objective consists in promoting the rise of the judicial or legal proceedings law, the recognition of an autonomous enforcement law and the introduction of an enforcement professional equipped with a harmonized status based on the model of the liberal and independent judicial officer (private model).
To carry out such an ambition, the Institute of International Private Judicial Law and Enforcement Law (IDJPEX) obtained a functional structure articulated around six elements:
- a scientific council
- an international training council (CIFHJ)
- a secretariat for the “international contest”
- a legal body of communication: “Juris-Union”
- a Training Unit for Africa (UFOHJA)
- a world “library”.
The UIHJ is facing a world filled with various cultures where lawyers from all areas of the Law exchange. This great diversity which causes richness maintains nevertheless a permanent need: that of the comparative study and the harmonization.
With this in mind, the mission of the Scientific Council of the UIHJ consists in directing research, bringing an analysis on the development of the law as regards globalization, participating in the works of the UIHJ, particularly at the occasion of congresses, and contributing to the publishing of legal articles or studies done under the auspices of the UIHJ.
The Scientific Council is composed of professors of universities, high-ranking magistrates, and lawyers specialized in international law, all of them having a good experience in the relations with the enforcement professionals. Its composition is set to represent the geographical expression of the UIHJ.
The Scientific Council is placed under the authority of the President of the UIHJ, Jacques Isnard. It is chaired by an administrator, Roger Dujardin (Belgium), Vice-President of the UIHJ, and has a secretary, Thierry Guinot (France), PhD in Law, Judicial Officer in Paris.
The composition of the Scientific council is as follows, in alphabetical order:
- Nadhir Ben Ammou (Tunisia), professor at the Law and Political Science Faculty of Tunis, lawyer at the Court of cassation
- Robert W. Emerson (the USA), Hubert Hurst professor of Business, Chair, department of management and Legal studies, Warrington College of Business Administration, University of Florida
- Frédérique Ferrand (France), law professor at the University Jean-Moulin, Lyon III
- Natalie Fricéro (France), professor at the Faculty of Law of Nice, director of the Institute of legal studies
- Burkhart Hess (Germany), law professor at the University of Heidelberg
- Ton Jongbloed (Netherlands), law professor at the university of Utrecht
- Aida Rosa Kemelmajer de Carlucci (Argentina), judge at the Supreme Court of justice of the province of Mendoza, professor to the Faculty of Law of Mendoza
- Ioan Les (Romania), professor at the Faculty of Law of Sibiu, former ambassador of Romania
- Paula Meira Lourenco (Portugal), assistant secretary at the presidency of the Council of Ministers
- Piemonrat Vattanahattai (Thailand), judge at the Supreme court, professor at the Faculty of Law of Bangkok
- Vladimir Yarkov (Russian Federation), PhD in Law, holder of the chair of civil and enforcement procedure, legal Academy of the State of Ural, Ekaterinbourg
A Prestigious Event
The very solemn ceremony, was held in the great amphitheater of the National Chamber of the French Judicial Officers, in Paris. Many French judicial officers, dressed in their Court outfit, had made a point of honouring with their presence this prestigious demonstration.
The UIHJ was represented by its president, Jacques Isnard, its 1st vice-president, Leo Netten, and its two vice-presidents, Yacine Sene and Roger Dujardin.
Jacques Isnard welcomed the whole of the participants and indicated how much this demonstration represented in his eyes the dedication of the actions which the UIHJ has carried out for more than ten years. He indicated all the interest of this Scientific Committee and thanked each interested party to have agreed to take part of it.
Roger Dujardin, administrator of the Scientific Council, presented its details. Then Thierry Guinot praised of each member, one after the other, collecting their reaction, except for Natalie Fricéro, who could not attend the meeting. Taking into account the impressive CV of all the members of the Scientific Council, one will understand that this presentation lasted nearly two hours.
Then, all convened in the new - very close - buildings of the National school of procedure of Paris (ENP), which one celebrated the inauguration, around a buffet, in the presence of the president of the National Chamber of the judicial officers of France, Guy Duvelleroy, several members of its office, and naturally of the president of the ENP, Jean-Michel Rouzaud and many members of the school.
At once after, the Scientific council started working and held its first meeting. Without revealing which will be the subjects on which the Scientific Council will work, let's say, there talks about documents initiating proceedings, mediation, sequestration of goods or multi-field judicial officers, ... In any event, Jacques Isnard announced the intention of the UIJHJ to give to the Scientific Council the place which returns to it within our organization.
